  1. SCOPE OF APPLICATION

1) These General Terms and Conditions of Sale (“Terms”) govern the sale of products and services through the Site and form an integral part of any Contract of Sale (“Contract”) that is concluded through the Internet between:

2) Any Order for the purchase of products from Carratelli Wine shall be governed by these Conditions, without prejudice to the Seller’s right to apply different and special conditions.

The applicable Conditions are those in effect at the time an Order is placed.

3) Carratelli Wine reserves the right to change these Terms and Conditions at any time, without prior notice.

4) These Terms do not regulate the sale of products or provision of services by parties other than Seller that are featured or referred to on the Site through links, banners, or other links.

In connection with such sales or supply of services, therefore, any form of liability on the part of the Seller is excluded.

 

  1. ORDERS

5) The Customer undertakes, before proceeding to confirm its Order, to read these Conditions and accept them by placing a check (flag) in the box indicated.

By placing an Order through the Site, the Customer warrants both that he or she has the legal capacity necessary to enter into legally binding contracts and that he or she is 18 years of age or older.

Customers placing Orders through the Site agree to the Terms and Conditions as follows.

6) The Seller offers its products for sale within the limits of stock available at the time of the Purchase Order. Orders may be subject to quantity limitations, minimum or maximum.

7) The Customer may purchase only the products in the electronic catalog of the Site at the time of placing the Order, as described in the relevant information sheets.

Product information on the Site, such as technical specifications, images, dimensions, or compatibility details, is not binding and may be subject to change at any time.

8) The technical steps to place an Order are clearly highlighted in the sequence of pages on the Site, through explanatory text and graphics.

9) By clicking “Confirm Order”, the Customer will formulate to Carratelli Wine a contractual proposal of purchase having as object the items contained in the Shopping Cart.

Receipt of the Order does not constitute acceptance of the contractual proposal to purchase.

10) In order to complete the Order, the following formalities must be successful:

  1. (a) Customer’s reading and acceptance, by “point and click,” of these Terms;
  2. b) compilation in electronic format by the Customer – by entering all the required data – of the Order Form, which contains a summary of the essential characteristics of each product or service chosen and its price; the means of payment for which the Customer has opted; the mode of delivery of the products purchased; the time and cost of shipping and delivery; the conditions for the exercise of the Customer’s right of withdrawal and the application of the legal guarantee of conformity; the manner and timeframe for the return of the products purchased;
  3. (c) payment, in favor of the Seller, of the price of the product(s) purchased by the Customer, including shipping and delivery charges;
  4. (d) automated forwarding by electronic means to the Seller of the aforementioned Order Form;
  5. (e) receipt electronically, by the Seller, of the above Order Form.

The placing of the Order implies the Customer’s express acknowledgement of the obligation to pay.

11) The correct receipt of an Order is confirmed by Carratelli Wine by e-mail to the e-mail address provided by the Customer

Such confirmation is generated automatically by the system and cannot be considered acceptance of the Order per se, but only confirmation of receipt of the Order.

The confirmation e-mail re-proposes all the data entered by the Customer, who agrees to verify their correctness and promptly notify any corrections.

12) Following receipt of an Order, Carratelli Wine will verify the availability of the products ordered and, only after such verification, will communicate its acceptance of the Order, by sending the Customer the Order Acceptance Receipt.

The Contract is concluded with the receipt by the Customer of the acceptance of the Order in the form of a Receipt sent by Carratelli Wine, or, in the absence of such acceptance, with the delivery of the items covered by the Order.

Once the Order Acceptance Receipt has been forwarded to the Customer, the Order may no longer be modified or cancelled, subject to the right of withdrawal under the terms and conditions set forth in Section VI of these Conditions below.

13) If Carratelli Wine is unable to process an Order received, it will promptly notify the Customer, and in any case before sending the Customer the Order Acceptance Receipt, except as provided in Article 14, paragraph 2 below.

In any event, Carratelli Wine reserves the right, at its sole discretion, to reject an Order, to set purchase limits, and to require prepayment.

Each Contract will cover only those products expressly and specifically stated in the Purchase Order.

Any form of liability, contractual or non-contractual, arising from the non-acceptance of an Order is excluded.

14) The Seller shall have the right not to process Purchase Orders placed in accordance with the provisions above, in the event that the Customer has not made payment for the products; or in the event that the Customer’s data is incomplete and/or incorrect; or even in the event that the products ordered are not, even temporarily, available.

If the Seller fails to process a Purchase Order placed by the Customer, the Seller will promptly notify the Customer, by electronic mail, of the foregoing and will refund any amount already paid by the Customer.

 

III. PAYMENT OF THE PRICE

15) The price of the products ordered shall be the price in effect on the day the Order is placed and shall be paid to the Seller in accordance with Article 10(c) above.

Shipping costs are not included in the purchase price, but are indicated and calculated at the time the Order is placed and before payment is made.

Unless otherwise provided, all prices shown on the Site are inclusive of VAT.

Carratelli Wine reserves the right to change prices at any time, without prior notice, unless the Customer’s Order has already been confirmed by the Seller pursuant to Art. 12.

In the event of a change in the price after the Order has been sent by the Customer and before confirmation by the Seller, the Seller will promptly notify the Customer by e-mail of the new price, and the Customer may accept the change or reject it and, consequently, waive the Order, at no additional cost.

Acceptance of the change must be communicated to Carratelli Wine, by e-mail or fax, within 7 days of its notification. Otherwise, the change will be deemed tacitly rejected and the Order will be deemed cancelled.

16) The Customer may pay for the products ordered through one of the payment methods indicated on the Site.

In the case of payment by credit card, the amount of the purchase will be charged to the Customer after the conclusion of the Order on the Site.

In case of cash payment, the amount of the Order will be charged to the Customer upon delivery of the products.

In the case of payment by bank transfer, the Customer will receive the bank details attached to the Order Form: the Order will be processed only upon receipt of the credit from the Seller.

The relevant financial information will be handled only by the payment circuits or the credit institution.

The aforementioned information may be used by the Seller only to complete the procedures relating to the payment for the products or services, or to provide for the making of refunds following the Customer’s exercise of the right of withdrawal referred to in Section VI of these Conditions below.

 

  1. SHIPPING AND DELIVERY OF PRODUCTS

17) Orders are processed from 9 a.m. to 5 p.m., Monday through Friday. Orders placed after 5 p.m. Friday will be processed the following Monday.

Unless otherwise provided in the Order Form, Carratelli Wine will ship the products purchased by the Customer, by courier, to the address indicated by the same, approximately within 24 working hours after acceptance of the Order.

Delivery takes place no later than 30 days after acceptance of the Order.

Carratelli Wine assumes no responsibility for inefficiencies attributable to force majeure or fortuitous event, even where dependent on malfunctions and failures of the Internet, in the event that it fails to execute the Order in the time provided by the Contract.

18) Should the purchased products be delivered outside the national territory, the Customer shall be responsible for the payment of any import charges and taxes, as well as any duties and customs duties provided for by the regulations in force in the territory of destination of the products.

19) The courier is responsible for delivery. Carratelli Wine is committed to collecting any reports of non-delivery or late delivery of products.

20) Any damage to the packaging and / or products, or the mismatch in the number of packages or indications, must be immediately contested to the courier through specific indication on the delivery document.

By signing the delivery document and in the absence of the aforementioned disputes, the Customer certifies the actual material integrity of the products and the conformity of the delivery.

The facts referred to in Paragraph 1 of this Article must be reported, by e-mail, to the Seller within 8 days after delivery, enclosing the invoice (if issued) and the copy, belonging to the Customer, of the courier’s waybill.

 

  1. BILLING

21) The Seller will issue an invoice to each Customer who has requested it and who, for this purpose, has entered his or her tax code and VAT number in the Order Form provided for this purpose. The information as provided by the Customer at the time of the Order shall be authoritative in this regard.

No invoice may be issued after submission of the Order Form unless requested at the time the Order is placed.

No changes to the invoice will be possible after it has been issued.

When placing an Order, you must indicate if the shipping address is different from the billing address.

If the Customer decides not to enter his/her tax code or VAT number, Carratelli Wine will not issue an invoice.

 

  1. RIGHT OF WITHDRAWAL AND RETURNS

22) Except as provided in Art. 59 of Legislative Decree. n. 206/2005, for purchases of machines and/or accessories, or other products, made through the Site, it will always be possible to exercise the right of withdrawal, in accordance with the provisions of the law, within the period of 14 days from the delivery of the products, by contacting the Seller for the modalities of return.

The goods must be returned, at the care and expense of the Customer, within 14 days from the date on which the Customer communicated to Carratelli Wine srl its decision to withdraw.

In the case of open and/or partially used products, the right of withdrawal does not apply and Carratelli Wine will inform the Customer, by e-mail. In this case, the Customer may ask the Seller, by e-mail, to return, at his own expense, the purchased products. Otherwise, the Seller reserves the right to retain both the products and the amount corresponding to the purchase of the products.

Carratelli Wine will only accept returns of goods in perfect condition and in their original packaging, accompanied by the relevant purchase invoice or, if missing, the relevant Order Acceptance Receipt.

In the case of service contracts, the withdrawal period shall end after 14 days from the day of the conclusion of the contract in the forms referred to in Article 12 above.

23) Except for exceptional exceptions, the return of food products such as capsules, cookies, coffee, sugar purchased on the Site will not be accepted.

24) Except as provided in the preceding provisions, once obtained the return of the products, Carratelli Wine will refund the amount actually paid by the Customer, using the same method of payment chosen by the Customer at the time of purchase.

In the case of payment made by bank transfer, the Customer shall notify the Seller of the relevant bank details necessary to make the refund.

If there is no correspondence between the recipient of the products indicated in the Order Form and the person who made the payment of the sums due for their purchase, the refund of the sums arising from the withdrawal will be made by the Seller to the person who made the payment.

The refund of the price paid by the Customer for the purchase of the products includes the shipping costs incurred at the time the Order was placed.

 

VII. WARRANTY

25) All products, other than food products, sold by Carratelli Wine are covered by the legal warranties.

26) The warranty shall consist in the replacement, at the Seller’s care and expense, of defective, erroneous or damaged products; or, where the replacement of products is impossible or excessively burdensome for the Seller, the warranty shall consist in an appropriate reduction of the price; or, again, in the termination of the contract, where the degree of nonconformity of the product is such that a mere reduction of the price is not acceptable.

In the case of defective, incorrect or damaged products, the Customer shall promptly, and in any case no later than the period specified in Article 27, contact the Seller by e-mail at info@carratelliwine.com, indicating the problem that has arisen.

Photographic material attesting to the originality of the packaging, cardboard inserts, as well as relating to the products received will need to be attached to the above written notice.

In the case of defective products, in addition to the notice referred to in the second paragraph of this article, the Customer is required to keep and return to the Seller the purchased bottles with at least ¾ of the contents with their original caps tightly sealed. Upon receipt of the goods and ascertaining the anomaly, the Seller will replace or refund the returned product.

27) The warranty is subject, under penalty of forfeiture, to the reporting of the defect or lack of quality, within 2 months after the Customer has received the purchased products.

28) The warranty shall, however, lose all effectiveness when changes are made on the products by the Customer.

 

VIII. APPLICABLE RULES OF LAW AND JURISDICTION

29) These General Conditions of Sale and the Contract shall be governed by Italian law, subject to the provisions of the 1980 Vienna Convention.

30) Any dispute arising from the application of these Conditions or the Contract shall be submitted to the jurisdiction of the Italian courts, in accordance with the provisions of current Italian legislation.
